Smart Honeymoon charges a service fee of 7.5% on the total of the gifts purchased from your registry. We charge this fee at checkout to the guest. Alternatively, if requested, we will not charge the guest, but rather deduct the fee from the proceeds of the registry total at the time the gifts are paid to the couple. There is no signup fee. We charge an additional $2.00 if the guest chooses to purchase a Smart Honeymoon customized gift card.
In the event of a cancellation or postponement of a wedding, or any other similar circumstance which may create the need for a refund or return of any or all of the gifts deposited with Smart Honeymoon, then we will refund to the guests all funds that are still deposited with Smart Honeymoon, including service charge. In the event that these funds have already been disbursed to the couple, it will be the couple's responsibility to take action to return these gifts to the guests. If a guest requests a refund of their own volition, and Smart Honeymoon still has the funds on deposit, we will refund the full charged amount, less the 7.9% service charge. If the gifts have already been delivered, it shall rest upon the guest to seek a return of the gift amount from the couple directly.
Smart Honeymoon provides this Terms of Use ("Agreement") to you as a user of Smart Honeymoon. By using Smart Honeymoon, you are indicating your willingness to be bound by all of the terms of this Agreement. If you do not wish to be bound by this Agreement, please do not use Smart Honeymoon.
We reserve the right to change the terms and conditions of this Agreement at any time and without prior notice to you, but such changes will be effective only when they are posted to this site. You agree to be bound by all of the terms of this and all future Agreements, as long as you use Smart Honeymoon.
By registering to become a member of Smart Honeymoon (“Member”), you attest that all information provided by you in the registration is true and accurate. To become a Member, you must provide some of the information requested in the registration form. Please read our Privacy Policy for specifics on how we will use each piece of information you give us.
Please note that Smart Honeymoon does not collect personal information from children under the age of 13.
Smart Honeymoon reserves the right to modify or discontinue Smart Honeymoon at any time without notice to you. Any such modifications or termination of service announcements will be posted to the web site. In the unlikely event that this should occur, all gifts received will be disbursed to the couple.
You agree to use Smart Honeymoon for lawful purposes only. You may not use, or allow others to use, your Smart Honeymoon membership, either directly or indirectly, to:

As a user, you are responsible for protecting your password. You agree that you will be responsible for any and all statements made while using this site, and acts or omissions that occur, through the use of your membership and password. If you have reason to believe or become aware of any loss, theft, or unauthorized use of your membership account or password, notify Smart Honeymoon immediately.
You understand that all information, text, messages, and any other material posted on Smart Honeymoon by Members (“Member Content”) is the sole responsibility of the person from which such Member Content originated. This means that the member, not Smart Honeymoon, is entirely responsible for the content that the member uploads, posts or otherwise transmits. Smart Honeymoon does not control the Member Content that is posted and therefore does not guarantee the accuracy or integrity of the Member Content. In addition, you acknowledge that you may be exposed to content that is offensive or objectionable to you.
Smart Honeymoon does not claim ownership of the Member Content you place on Smart Honeymoon. Except as limited and regulated by our Privacy Policy, by placing content on Smart Honeymoon you grant Smart Honeymoon an unlimited license to republish, reproduce, modify and adapt the Member Content for the purpose of administering and promoting Smart Honeymoon.
While Smart Honeymoon does not and cannot review all transmissions by Members, you acknowledge that Smart Honeymoon reserves the right to, and may from time to time, monitor any and all information transmitted or received through Smart Honeymoon. Smart Honeymoon, at its sole discretion and without further notice to you, may review, remove or prohibit Member Content that Smart Honeymoon deems inappropriate or that violates any term or condition of this Agreement.
Smart Honeymoon Content is defined as any information, data, text, messages, articles, software, methods or processes, photos, video, graphics, music, sounds and any other material or services that are found on Smart Honeymoon, excluding Member Provided Content. By accepting this Agreement, you agree that all Smart Honeymoon Content is the sole property of Smart Honeymoon and Smart Honeymoon and its licensors shall retain all right, title and interest in and to the Content, which may not be reproduced without prior written consent of SmartHoneymoon.com. All Smart Honeymoon Content herein is protected under US and international copyright, trademark and other laws and is only intended for the personal use of the Members. You may not modify, publish, retransmit, participate in the transfer or sale of, copy (other than temporary copies that may appear in or be created by your browser), create derivative works of, distribute, perform or display any of the Smart Honeymoon Content in any way.
Smart Honeymoon may provide links to other Internet sites or resources. You acknowledge that Smart Honeymoon is not responsible for the availability of, and does not endorse or assume responsibility for, any content, products, policies or other materials on such sites, nor does it assume any responsibility for your reliance on or use of content, products or other materials obtained from such sites.
You acknowledge that Smart Honeymoon has the right to advertise and post promotions on Smart Honeymoon. You acknowledge that site users may not advertise or post promotions on Smart Honeymoon without express permission from Smart Honeymoon.
You agree to indemnify, defend and hold harmless Smart Honeymoon from and against any claim, liability, cost, damage or loss it may incur (including, without limitation, attorneys fees) as a result of (i) your use of Member Content or Smart Honeymoon Content; (ii) any content provided by you; (iii) any violation by you of your obligations under this Agreement; and (iv) any violation by you of the rights of others.
The trademarks, logos, and service marks (collectively the “Trademarks”) displayed on Smart Honeymoon are the registered and unregistered Trademarks of Smart Honeymoon and others. Except as provided in this Agreement or by written permission of Smart Honeymoon, your use, appropriation or misrepresentation of the Trademarks displayed on this site is strictly prohibited. Smart Honeymoon will aggressively enforce its intellectual property rights to the fullest extent of the law.
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes the service provided by the Smart Honeymoon web site or its use or access.
Smart Honeymoon may place limits on the use and storage of data on our site. For example, Smart Honeymoon may limit the length of time that Member Content can remain on the site, or set limits regarding maximum or minimum levels of activity. You agree that Smart Honeymoon will not be responsible or liable for the deletion of messages or content on the Smart Honeymoon site, and agree that Smart Honeymoon reserves the right to terminate accounts that are nactive for an extended period of time without notice. Smart Honeymoon reserves the right to change our practices regarding the use and storage of data on Smart Honeymoon at anytime without notice to users.
To the best of its knowledge, the information and services provided to you by Smart Honeymoon are accurate. You acknowledge that Smart Honeymoon expressly disclaims all other warranties of any kind, whether express or implied, regarding the completeness, truth, accuracy, non-infringement, merchantability or fitness of the content found herein for any particular purpose. All information provided on Smart Honeymoon is to be used on an “as is, at will with all faults” basis. Further, Smart Honeymoon makes no warranty that service will be uninterrupted, timely, secure or error-free, that any files available for downloading will be free of viruses, worms or other code that manifest contaminating or destructive properties, or that the quality of any services, information, or other material will meet your expectations.
You acknowledge that although Smart Honeymoon may provide you with the opportunity to support charitable and/or other non-profit organizations through the use of our services, you understand that Smart Honeymoon is a privately owned company. You further acknowledge that Smart Honeymoon is not responsible for the transactions you may conduct with the charitable/non-profit organizations as a result of your use of the Smart Honeymoon services. Smart Honeymoon is not responsible for monitoring, confirming, or reviewing the conduct, status, representations, or other actions or omissions of the charitable/non-profit organizations.
You agree that Smart Honeymoon will not be held liable to anyone for any loss or injury resulting from your direct or indirect use of Smart Honeymoon. This includes, but is not limited to, loss or injury caused in whole or in part by contingencies beyond Smart Honeymoon's control in procuring, compiling, interpreting, reporting, operating or delivering any portion of Smart Honeymoon. Further, you agree that Smart Honeymoon assumes no responsibility for any and all transactions you may conduct with any parties as a result of your use of the Smart Honeymoon services. Some jurisdictions do not allow the disclaimer of such warranties, so this may not apply to you, but the disclaimer will apply to the furthest extent allowed by law.
You acknowledge that Smart Honeymoon will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Smart Honeymoon has been advised of the possibility of such damages), resulting from or related to the use or inability to use Smart Honeymoon. Some jurisdictions do not allow the waiver of such damages, so this may not apply to you, but the waiver will apply to the furthest extent allowed by law.
You acknowledge that Smart Honeymoon makes no claims or promises regarding any and all tax obligations or consequences that may result from your activities as a Member of Smart Honeymoon and your use of the services provided by Smart Honeymoon. Furthermore, you agree that Smart Honeymoon has no obligation to maintain records or provide you with documentation of your transactions with charitable/non-profit organizations for tax reporting purposes.
If any provision in this Agreement is invalid or unenforceable under applicable law, it will be enforced to the furthest extent possible and the remaining provisions will continue in full force and effect. This Agreement, your rights and obligations, and all actions contemplated by this Agreement will be governed by the laws of the United States of America and the State of New York (except with respect to choice of law), as if the Agreement were a contract wholly entered into and wholly performed in New York, New York. Any dispute, controversy or claim arising out of or relating to this Agreement will be resolved exclusively in the federal or state courts located in New York, New York and you hereby consent to the jurisdiction and venue of such courts.
